Welcome to my website photoswithnoir.co.uk, My name is Chinedum Noir "Photos Noir". By booking a service or using this site, you agree to the following Terms and Conditions.

1. Use of My Website

You must be at least 18 years old, or have parental/guardian consent, to use my services.
You agree not to misuse the site, interfere with its functionality, or attempt unauthorised access.

2. My Services

I provide photography services as outlined on this site.
All bookings are subject to availability and confirmation.
Prices may change without notice, but confirmed bookings will not be affected.

3. Payment and Booking

A deposit is required to secure your booking. All deposits are non-refundable.
Full payment is due within 14 days of receipt of final images, unless we agree otherwise in writing.
If payment is not made within this timeframe, I reserve the right to add late payment charges (see Section 6).

4. Cancellations and Rescheduling

You may cancel or reschedule without penalty up to 48 hours before the scheduled session.
If you cancel with less than 48 hours’ notice, your deposit will be forfeited.
I may need to reschedule in cases of illness, emergencies, or conditions beyond my control.

5. Delivery of Images

Final edited images will normally be delivered within 2–3 weeks of the session, unless we agree otherwise.
Images are provided digitally via an online gallery (or other agreed format).
Online galleries will remain available for 30 days after delivery. Please download and back up your images within this period.

6. Late Payments

Invoices not paid within 14 days will incur a £25 late fee.
Interest will be charged at 5% for every two-week period the balance remains overdue, until payment is received in full.
If further action is required to collect payment, you will be responsible for any reasonable collection costs.

7. Editing & Retouching

Standard editing includes colour correction, cropping, and light retouching.
Extensive editing or special requests (e.g., body reshaping, background replacement) may incur additional fees.
RAW or unedited files are not provided unless agreed in advance.

8. Client Responsibilities

You are responsible for being on time and ensuring access to the shoot location.
Any required permissions for shooting at venues must be arranged by you in advance.
Late arrivals: If you arrive late, the session may be shortened to fit within the agreed booking time and the full fee will still apply.
No shows: If you fail to attend without notice, your deposit will be forfeited and you may be charged the remaining balance of the session fee.

9. Force Majeure

If I am unable to perform the session due to illness, accident, extreme weather, strikes, or other circumstances beyond my control, I will work with you to reschedule.
Deposits remain non-refundable, but your session will be moved to the nearest available date.

10. Image Rights and Usage

I retain copyright of all images taken unless we agree otherwise in writing.
You are granted a license to use the images for personal or agreed purposes.
You may not alter, sell, or use the images commercially without my written permission.
I may use selected images for my portfolio, website, or marketing unless you request otherwise in writing.

11. Liability

While I take the utmost care, I cannot be held responsible for circumstances beyond my control (e.g., weather, technical issues, venue restrictions).
My liability is limited to the value of the service booked.

12. Privacy

I respect your privacy and handle all personal information in line with my Privacy Policy.

13. Governing Law

These Terms are governed by the laws of Wales /United Kingdom. Any disputes will be handled in the courts of Wales and England.

14. Changes to These Terms

I may update these Terms from time to time. Updates will always be posted on this page with a new “Last updated” date.
